How and Why Mediation Works

  • Mediation is voluntary.
  • Parties come together to discuss their issues, agree to listen to each
        other without disturbing or interrupting each other.
  • Rules dictate parties show respect to each other and the third
        party IMPARTIAL mediator.
  • Each party has the chance to tell their story and position.
  • The Mediator listens without a bias to either party.
  • Each party, positive or negative, begins to understand the conflict from
        the others point of view and the Mediator attempts to bring parties to a
        mutual agreement making both parties a winner.
  • A formal agreement is written by the Mediator and signed by both
        parties which can make a legally binding agreement, depending on the
        circumstances.
  • If you go to court, a Judge makes the decision for you and the result is
        generally a winner and a loser………..
